OWA Program: Mediation in Construction

Zee Claiborne will talk about mediation and arbitration as solutions to the legal problems of architects and will give examples from some of her cases. Most construction disputes go to mediation or arbitration. Zee will address how design professionals can use these techniques to resolve claims. to settle fee disputes and to deal with professional liability insurers.

Zee Claiborne is a full time mediator and arbitrator who specializes in the resolution of complex commercial, real estate, and construction matters. She is based in northern California and often travels to handle cases. Much of her practice is devoted to mediation and she has successfully mediated hundreds of disputes, including multi-party disputes ranging in value up to several millions of dollars. Also, she has successfully resolved several international matters through mediation/conciliation. In addition, she has served as an arbitrator on many international and domestic cases. Ms. Claiborne has been a panelist with the American Arbitration Association since 1991 and currently serves on both the National and International Rosters of the AAA. She serves on the AAA's Board of Directors, the Northern California Advisory Council, and the Large and Complex Case Panel (LCCP). Further information is available at www.zclaiborne.com.

Before starting her full time ADR practice in 1998, she was a general partner at a large San Francisco law firm, where she tried cases and specialized in complex litigation and ADR. She frequently speaks and writes on ADR topics and has taught in training programs for both mediators and arbitrators. Her professional activities include the Association of Business Trial Lawyers (Editorial Board and author of ADR column, 1991-2001), the College of Commercial Arbitrators (Fellow), the Governing Committee of the American Bar Association's Forum on the Construction Industry (1996-1999), the American College of Construction Lawyers (Fellow), the International Arbitration Club, and the Mediation Society. She graduated from the University of California at Berkeley (Boalt Hall) with a JD in 1982.
